THE SOURCE STUDY AND ANALYSIS OF THE 18 TH CENTURY DAGESTANI LEGAL SOURCE «FATWA OF IBN SALMAN AL-KUDALI»

The article is based on the content analysis of the most popular written work in the Arabic literary genre in Dagestan, known as “al-Fiqh”. The article is devoted to the examination of Muslim legal provisions which are treating the issue of Shia in the pre-Russian Dagestani work Fatwa by Ibn Salman al-Kudali. He was a jurist and enlightener of the 18th century. The author provides a thorough description of the Dagestan Arabic manuscript, conducts into a scientific circle the formerly unstudied legal work in the Russian Oriental Studies. The attention is focused on the main milestones of life, education and activity of Ibn Salman al-Kudali, who was not a hardliner of a particular legal school when deducing his legal statements in particular issues.
